Do you have to have guardianship of a child to be arrested for child abandonment?

My sister is a real tramp, and she has two twin daughters. She's planning on leaving with some jerk she doesn't even know and move in with him. My mom has guardianship over the girls, but works all day. If my sister abandons those girls and leaves them here alone, will happen to her?
